registrar will consider each such application on its merits.
The registrar's decision concerning
any such applications shall be final.
Reserved Words
A list of reserved names is
maintained by the Registrar at their discretion in consultation with the
Governments of the Channel Islands and is not open to inspection. This is to
avoid registration of obscene or offensive domains or domains which may damage
the interests of the islands.
Certain other words are reserved to
allow for future expansion of the Guernsey and Jersey domains.
Proposed registrations will be not
be accepted if they are for words which are contained on the list of reserved
names Generic Names
To allow the widest use of limited
domains, registrants agree that generic domain-names may not be challenged by
holders of similar generic domains providing that the address of the domain is
accurately represented (i.e. a holder of videos.gg cannot object to the holder
of videos.co.gg or videos.org.gg using these domains for the provision of
video-related services). In the event of a dispute about whether a name is
generic for the services offered, parties are expected to use the the
Alternative Dispute Policy once in operation.
Hyphens in domain
names The registrar reserves the right to
refuse an application for a proposed name if it is identical, save for the
inclusion of one or more hyphen ('-') characters, to another domain name which
is already registered.
Opportunity to upgrade For a
limited time, registrants holding .co.gg and co.je domains will be offered a
first opportunity to register a domain corresponding to their .co domain in the
top level .gg or .je domains. This will not apply to domains of less than four
letters, or to reserved words.
Payment of Fees
Any registration is subject to an
initial application fee (payable at the time of application) and an annual
registration fee paid at the time of application or anniversary thereof.
Non-Payment In the event that
registration fees are not paid within 60 days of the anniversary of
registration, the Registrar is permitted to revoke the existing registration
and to make the domain name available for re-registration. Renewals are the
responsibility of the registrant of a domain and the Registrar's sole
responsibility shall be to e-mail the billing contact e-mail address currently
on record 14 days prior to any revocation of registration being made.
Certification by
Applicant By applying for an Internet Domain
Name in the Guernsey (.gg) or Jersey (.je) registries , the applicant certifies
that he or she has the right to use the name, and hereby indemnifies the
Registrar in the event of any dispute arising over the registered Domain
Name. Acceptance of Terms and
Conditions
By applying for the domain name and
through the use or continued use of the name, the applicant certifies that they
are bound by the terms of the Registrars' current naming standards, policies
and Terms and Conditions as amended from time to time. In the event that a
registrant does not accept the Terms and Conditions, the registrant must
immediately surrender the domain name.
If an application is made through an
agent, such as an Internet Service Provider, that agent accepts the
responsibility to notify the applicant of the conditions on the registration of
the Domain name and to provide the applicant a copy of the current version of
the Terms and Conditions. Upon receipt of an application, the applicant and
agent shall both be deemed to have had notice of the Terms and Conditions and
any failure by the applicant to be bound by the Terms and Conditions shall
immediately operate to revoke the domain registration. In the event that
revocation occurs more than 7 days after the Registrar's database has been
altered to show the applicant's registration, no right to refund of any fees
shall exist. Amendment of Terms and
Conditions The applicant acknowledges and
agrees that the Registrar may change Terms and Conditions from time to time
under the conditions contained within them. No person is authorised to allow
registration under any terms and conditions except the standard Terms and
Conditions of the Registrar at the time of application for the Domain Name or
any standard Terms and Conditions subsequently imposed by the Registrar.
Disputes relating to Names
The applicant agrees that if the use
of the name is challenged by any third party, or if any dispute arises under
this Registration Agreement, as amended, the applicant will abide by the
procedures specified in the Terms and Conditions. Registering an Internet Name
does not confer any legal rights to that name and any disputes between parties
over the rights to use a particular name are to be settled between the
contending parties using normal legal methods.
The Registrar is aware that cost of
court process can be very expensive and will shortly be offering a Domain Name
Dispute Policy utilising a cost-saving method of on-line ADR (Alternative
Dispute Policy), full details of which will be available on the Registrar's
homepage in due course.
Unwanted Unsolicited Bulk Email
('Spam')
The use of any domain for the
purposes of sending unsolicited bulk email ('spam') is prohibited. Any
complaint about abuse of the domain for the purposes of 'spam' (which is made
to the registrar and upheld) may result in the registrar de-registering the
domain upon any repetition of 'spam' from that domain
. Pornography
The use of any domain for the
purposes of promoting hard-core pornography is prohibited. Upon receiving a
complaint about abuse of a domain for the purposes of pornography, the
registrar may de-register the domain without notice.
Limitation of Liability
All liability (except for personal
injury or death or fraudulent misrepresentation) is excluded and the maximum
remedy or award (if any) available in respect of any domain against the
Registrar shall be the cost of the current year's annual registration fee for
the domain. Governing Law
This Registration Agreement shall be governed in all respects
by and construed in accordance with Alderney Law. Entire Agreement
This Registration Agreement in
conjunction with the Terms and Conditions is the complete and exclusive
agreement of the applicant and the Registrar, Island Networks, regarding domain
names registered under the .gg or .je domains. It supersedes, and its terms
govern, all prior proposals, agreements, representations, or other
communications between the parties.
